Terms and conditionsin the short term, in the long term, strategy

Please read our terms and conditions properly  first before starting any project with us. We prefer to avoid any misunderstanding during and after the project. Thank you for your compliance.

OUR TERMS OF SERVICE:

Our company is registered as Seeker Spectrum Enterprise (002245659-U) as per SSM. 

The price and specifications displayed on our website may change if there are any add-on services and/or specification changes requested by the client.

We have the rights to change the price and/or the specifications and/or the terms of service without any prior notice as long as the client has not made payment to us through the payment gateway. In order to provide more affordable services, we prefer direct bank transfers to avoid any middle man commissions. Our charges will change to add in the payment gateway processing charges, which will be borne by the client.

In addition, by paying for our service, the client is deemed to have read and agreed to all our terms of services.

Communication channels:

We have the rights to determine the channel of communication during development.

The primary channel is e-mail and the secondary channel is messaging app such as WhatsApp, Telegram and WeChat. We may communicate through Zoom and/or Skype whenever necessary.

Targeted project timeline:

We target to complete the web design within fourteen (14) working days or earlier from the date of payment by the client, PROVIDED:

The client has provided all the content to us within three (3) working days from date of payment.

The client must request for extension of time if unable to meet the targeted deadline as stated above.

The client must respond to all our request(s) and/or inquiries within twenty-four (24) hours from the time of our inquiry. Extension of time to respond is allowed but must in writing (via email);

The client does not delay in any decision making with regards to the website.

 All the content provided by the client are not erroneous and/or incomplete.

If any of the terms above is breached, we have the rights to extend the project timeline by another seven (7) working days [1st extension] from the end of the original targeted timeline which is fourteen (14) working days from the date of payment.

If any terms in is breached, a final grace period of five (5) working days [2nd extension] will be given to the client. We have the rights to terminate this project if the client fail to provide us all the content that we have requested and/or refuse to respond to our request(s) during the development period. Refer to Terms of Services below.

If we are unable to meet the deadline, we must inform the client via email at least two (2) working days before the deadline (14 working days from the date of payment). We have the rights to extend the timeline by another fourteen (14) working days.

If the project has exceeded five (5) working days from the 2nd extension of the timeline due to client’s delay, we reserve the rights to charge an hourly rate of RM 75.00 per hour to complete the remaining work.

Delivery and add-on services:

All project delivery are as defined in our packages. We have the rights to charge for any additional requirement(s) or expansion of existing specification(s) or service(s) before and during the period of development that is not defined on the paid package.

Example of additional services such as content correction, copy writing, product photo editing, video editing, extra digital designs, social media setup, translation service, upload of images on the website more than 15,  purchase of additional plugin or plugin upgrades to premium version etc.

Adjustment to page design:

Our packages are designed to enable you to have a website at the shortest time possible. We do not allow significant change or alteration on the template structure as seen in or sent to us from other website links.

Any adjustments or alteration shall not be more than twice per page. If exceeded this limit, we have the rights to extend the project timeline and charge RM 50.00 per hour to complete the affected page. If the adjustment has affected the timeline, refer to terms of services 4 above.

Payment policy:

Our packages are designed for fast completion. We offer different packages to our clients as below:

Standard: Payment in full 100% before project start.

The client has to be clear about the services needed from us. The payment will be charged accordingly. Any additional work will only be done after payment of required addition.

Termination and Refund policy (READ CAREFULLY!)

The client is deemed to have agreed all our terms of service when payment is made. However, we allow termination and refund only if the conditions below are met and we will forfeit 10% of the total project value.

We will refund 90%, if the client request for refund within 24 hours from the time of order (based on the time we receive the email).

We will refund 80%, if the client request for refund after 24 hours but within 48 hours from the time of order (based on the time we receive the email).

We will refund 60%, if the client request for refund after 48 hours but within 72 hours from the time of order (based on the time we receive the email).

No refund after 72 hours from the time of order (based on the time we receive the email) as we have already commenced work on the client’s project. The client understand this is a fast development project, our team will proceed to execute the task the moment an order is received and we have already incurred development costs. Therefore, it is up to our discretion whether to refund any balance to the client.

The client must provide us the order number, contact person name, contact person number, bank name and bank account number via email.

We have the rights to terminate the project if the client breached our terms of service without any refund.

All refund will be process and transfer back to the client’s bank account as provided in the email within fourteen (14) working days from the date of approval of the refund. All assets provided and whatever work done shall be destroyed.

Warranty:

Valid for seven (7) calendar days only. The warranty will start on the same day the website is Live. The Live date will be determined once the project starts.

Seeker Spectrum will not entertain or provide any post project repair if the client has installed or changed any settings to the site which might have caused the site to crash or malfunction. 

Job scope:

Tech support includes investigation on any inquiry raised by the client (must be related to the website) and bug fixing (if any).

The service excludes creation of page(s), adding new function(s)  to alter the website or request to customize the website.

We do not do any custom web coding for any website. Web coding is available on different website firms and are much costlier than the service provided by us.

We only provide website designs based on the templates provided by us. 

Our working hour: 9:00 a.m. to 6:00 p.m., Monday to Friday. Closed on Saturday, Sunday and Public Holidays.

We have the rights to respond to any inquiry raised by the client within 48 hours from the time the inquiry is sent to us via email.

We have the rights to void this warranty if the client breach any of the terms in this package.

Domain name:

The domain name shall belong to the client.

The domain name will be purchased from our resellers or by the client themselves.

Hosting has to be bought from our recommended third party sellers only. 

Please note that domain and hosting charges are annual or 2-3 years. This is a cost incurred by the client. upon purchase the client will be given access to their account, if bought by us. Annual renewal of these third party products is the client’s responsibility. Seeker Spectrum takes no responsibility for any website loss due to client’s irresponsibility.

The client must provide up to two (2) domain name suggestions (clearly state which is primary option) so that we can check for availability.

If the primary option is not available but the secondary option is available, we will purchase the secondary name

We will request the client to provide two (2) more name suggestion if both the domain name is not available.

If the client wish to purchase additional domain name, it will be considered a separate service where we will charge a cost price plus RM100.00 set up fee (one-time).

Access:

The following access will be provided via email within seven (7) working days from the Live date of the website:

The content management system (CMS).

The domain and server account purchased from our hosting and domain providers.

Use for the client website as a portfolio or for advertising purposes:

The client hereby grants us the right to use the work for demonstration of past work performed via portfolio or advertising and allowing us to put the following text “Web Design by Seeker Spectrum” and including our company link at the footer of the website. In return, we shall give the client one (1) hour worth of free web maintenance credits.

If the client leaves us a positive review on our Facebook page or send us a testimony, we will give them one (1) hour of extra credit

If the client does not permit the above, the client must inform us via email. As the condition above is not met, no free maintenance credit given.

Document Forms:

Physical documents will only be provided upon request and may be subjected to charges. Otherwise, all documents will be in digital form.
